A federal court ruled on Friday that Trump, as president, may be able to avoid civil action for his role in the January 6, 2021, attack on the US Capitol. But candidate Trump is something different.

Donald Trump, the president, may well be immune from any civil action for allegedly inciting an attack against the US Capitol on January 6, 2021. But Donald Trump, the candidate, is not, an appellate court in the District of Columbia says.

“When a first-term President opts to seek a second term, his campaign to win re-election is not an official presidential act,” says a ruling handed down this morning.

The court’s unanimous decision to reject Trump’s claim of absolute immunity places the Republican frontrunner in increased financial jeopardy, paving the way for members of Congress and Capitol police to seek compensation for harms allegedly endured during a riot that resulted in millions of dollars in damages and caused injury to nearly 140 police officers, according to their union.

In a 67-page opinion, the court says that Trump failed in his attempt to demonstrate that he’s entitled to what’s called “official-act immunity,” a powerful liability shield afforded to presidents that aims to ensure that they can—as the court puts it—“fearlessly and impartially discharge the singularly weighty duties” of the presidency.

“We answer no,” the court says, “at least at this stage of the proceedings,” adding that “campaigning to gain that office is not an official act of the office.”

The ruling has been long awaited. Trump’s claim of immunity was first rejected by US district court judge Amit Mehta in February 2022.

In part, it was Trump’s own attempt to overturn the election at the US Supreme Court that may have doomed his case. The DC Circuit says he acknowledged that his post-election efforts to have the result reversed in his favor were done in a personal capacity, and not that of a sitting president. Those claims, the ruling says, certified that Trump sought the court’s intervention based on his own “unique and substantial” interests as—specifically—a candidate.

Trump’s attorney has argued that the distinction is immaterial, and the appellate court unanimously disagreed. However, the matter of immunity was the sole issue under consideration, and Trump’s liability has yet to be determined.

The US Justice Department, asked by the appellate court to weigh in on the matter last year, concluded in March that Trump could be sued over the attack, adding that while presidents are afforded great protection with regard to a “vast realm” of speech, it did not extend to the “incitement of imminent private violence.”

The civil case is separate from the federal criminal trial in the district, which was led by special counsel and former acting US attorney Jack Smith and concerns not only Trump’s attempt to overturn the election, but allegations that he unlawfully retained classified documents at his Mar-a-Lago estate in Florida. Earlier this week, former vice president Mike Pence reportedly told the special counsel that Trump’s advisors—“crank” attorneys, as Pence put it—pushed the country to the brink of a constitutional crisis. The case is set to go to trial this March.

The siege began shortly after Trump delivered a 75-minute speech at a park south of the White House, known as the Ellipse. A House select committee investigating the riot last year said that Trump was aware the attack on the Capitol was underway as he arrived at the White House roughly 15 minutes after the speech. Witnesses, including a former DC police sergeant, claimed at the time that Trump had been swept away by US Secret Service agents trying to prevent him from joining the march.

Trump’s then press secretary, Kayleigh McEnany, later testified that during the attack Trump had requested a list of phone numbers belonging to US senators on the Hill, whom he reportedly contacted in an attempt to stop the results of the 2020 election from being certified. The calls were not recorded on the presidential call log. During this time, Trump supporters were engaged with police officers and had begun forcing them back onto the Capitol lawn, throwing bottles and dousing several offices with chemical spray.

The attack lasted approximately two hours and resulted in five deaths, including that of a Capitol police officer. The rioters, who broke windows, ransacked lawmakers’ offices, and stole documents and electronics, reportedly caused more than $2 million in damages to the 222-year-old building.

Two Capitol police officers, James Blassingame and Sidney Hemby, are seeking $75,000 in compensatory damages (as well as unspecified punitive damages) for injuries they say they sustained in the attack. In a court filing, Blassingame, an officer of 19 years, says he was struck in the face, head, and up and down his body by Trump supporters during the attempt to breach the Capitol building. Hemby, a former Marine, suffered “cuts and abrasions” to his face and hands. Neither officer could be immediately reached for comment.

At the onset of the suit, the plaintiff lawmakers included Democrats Eric Swalwell, Stephen Cohen, Bonnie Coleman, Veronica Escobar, Pramila Jayapal, Henry C. Johnson, Marcia Kaptur, Barbara Lee, Jerrold Nadler, and Maxine Waters. Karen Bass, a former congressperson and current mayor of Los Angeles, has also joined the suit. The lawmakers, including Bass, either did not respond or declined to comment.

“The Court today confirms that no one is above the law, even presidents while engaged in conduct during their presidency," Representative Johnson says.

Bennie Thompson, the congressperson from Mississippi, says he was no longer party to the case on appeal but welcomed the court’s decision. “Donald Trump should not be able to use the presidency to shirk accountability for what he did to cause the insurrection on January 6,” he tells WIRED.

An attorney for Trump, Jesse Binnall, did not immediately respond to a request for comment.

CVE-2023-45168: Security Bulletin: AIX is vulnerable to arbitrary command execution due to invscout (CVE-2023-45168)

Domain fronting is a technique to hide the true origin of HTTPS requests by hiding the real domain name encrypted inside a legitimate TLS request.

Domain fronting is a technique of using different domain names on the same HTTPS connection. Put simply, domain fronting hides your traffic when connecting to a specific website. It routes traffic through a larger platform, masking the true destination in the process.

The technique became popular in the early 2010s in the mobile app development ecosystem, where developers would configure their apps to connect to a “front” domain that would then forward the connections to the developer’s backend. This way, the developer could expand their backend to deal with growing traffic and new features without constantly having to release app updates.

But as is true or many good things, it also comes with a flipside. Domain fronting allows malicious actors to use legitimate or high-reputation domains which will typically be on the allow-lists of defenders. The legitimate domains often belong to Content Delivery Networks (CDNs), but in recent years a number of large CDNs have blocked the method. The list includes Amazon (banned in 2018), Google (2018),  Microsoft (2022), and Cloudflare (2015).

A CDN is basically a large network of proxy servers and data centers and it can be used to host multiple domains. They are also known as content distribution networks. It’s what companies like Netflix use to deliver the requested content from a server near you.

For a “normal” connection to a website, a Domian Name System (DNS) finds the IP address for the requested domain name. As I explained in the blog DNS hijacks: what to look for, DNS is the phonebook of the internet to the effect that the input is a name and the output is a number. The number that belongs to what or who you want to reach.

With two domains hosted on the same CDN, HTTPS can be used to make it seem as though the user is connecting via a website that is unrestricted. HTTPS protocols are encrypted, so it can be used to discreetly connect to a different target domain. So an attacker can hide an HTTPS request to a restricted site inside a TLS connection to an allowed site.

In domain fronting, the process is the same but it will make an HTTPS request that appears to be from a different domain. It does so by mimicking the secondary domain’s DNS and TLS requests which makes it seem as though the user has connected from another domain. This method is popular as a means to evade online censorship and bypass restrictions.

The technique was adopted by online services like Tor, Telegram, and Signal to bypass internet censorship attempts in oppressive countries. When both Amazon and Google blocked domain fronting on their platforms, some suspected the Russian government was behind it because at the time, the Russian government blocked 1.8 million AWS and Google Cloud IP addresses in an attempt to frustrate access to Telegram’s instant messenger.

Because of the ability to hide backend infrastructure, domain fronting has also gained popularity within malware operations. They can use domain fronting to set up a command and control (C2) channel on a seemingly legitimate domain to bypass defensive techniques. The owners of good reputation sites cannot prevent their hostnames being abused for this activity.

The best defense against domain fronting in an enterprise organization is a cloud-based SWG (Secure Web Gateway) service with unlimited TLS interception capacity. A secure web gateway (SWG) is a network security technology that sits between users and the internet to filter traffic and enforce acceptable use and security policies. With an SWG or other tools with similar functionality, you can detect mismatches between the TLS Server Name Indication (SNI) and the HTTPS host header, and get a warning about domain fronting.

Apple has recently released security updates to tackle two zero-day vulnerabilities (CVE-2023-42916 and CVE-2023-42917) that hackers are actively exploiting.

Apple Inc. today released crucial security updates aimed at mitigating two critical zero-day vulnerabilities identified as CVE-2023-42916 and CVE-2023-42917. These vulnerabilities have been actively exploited by hackers, posing a significant risk to a wide range of Apple devices.

The vulnerabilities allow attackers to execute arbitrary code and access sensitive data on compromised devices. These security flaws are particularly concerning because they can be exploited through malicious web pages, exploiting a memory corruption bug to gain unauthorized access.

In a comment to Hackread.com, Michael Covington, VP of Portfolio Strategy at Apple device security and management company Jamf, urged users to immediately update their devices.

“These latest OS updates, which address bugs in Apple’s WebKit, show that attackers continue to focus on exploiting the framework that downloads and presents web-based content,” Michael said. The latest bugs could lead to both data leakage and arbitrary code execution and appear to be tied to targeted attacks that are common against high-risk users,” he wanted.

****How to Update Your Apple Devices?****

Apple provides detailed instructions to ensure that users update their devices effectively. For iPhone and iPad users, navigate to Settings > General and click on Software Update.

For macOS users, click on the Apple menu (), go to System Settings, select General, and then click on Software Update. Automatic updates should be enabled to receive the Rapid Security Response patches seamlessly. Restarting the device may be necessary to complete the update process.

Apple Issues Urgent Security Patches for Zero-Day Vulnerabilities

Security updates are tedious and difficult, so users continue to use a weak version of a core protocol and remain exposed to major attacks on critical infrastructure.

Programmable logic controllers (PLCs) that were vulnerable to the Stuxnet attack are still in use globally and rarely have security controls deployed — meaning they're still at risk.

More than 10 years after Stuxnet, new research shows users rarely switch on security controls such as using passwords, and feel updates are too cumbersome to be applied.

Colin Finck, tech lead of reverse engineering and connectivity at Enlyze, says the Siemens proprietary protocol which is used to read and write data as well as to program the S7 PLC. However, this is only protected by obfuscation, which the researchers were able to bypass.

Finck and his colleague Tom Dohrmann, software engineer, reverse engineering and connectivity, will present their findings at Black Hat Europe in London next week, in a talk titled "A Decade After Stuxnet: How Siemens S7 Is Still an Attacker's Heaven."

**Still Feeling the Stuxnet Effects**

In the 2010 attack, the Stuxnet attackers exploited several zero-day vulnerabilities in Microsoft Windows to ultimately gain access to Siemens software and the PLCs. This was done to gain access to and effectively damage high-speed centrifuges at the Iranian Bushehr nuclear power plant.

The impact of Stuxnet was huge, as it remotely damaged around a thousand centrifuges, and the worm's controllers were also able to analyze communication protocols between the PLCs to exploit further technological weaknesses. It also paved the way for things to come: After Stuxnet, a number of industrial control-related attacks were detected over the years, including BlackEnergy and Colonial Pipeline.

Finck tells Dark Reading that after the Stuxnet attacks took place, Siemens developed a revised protocol for the PLCs that added "lots of obfuscation and cryptography layers." However, the researchers in recent probing were able to bypass that obfuscation to give them the ability to read and write instructions for the PLCs, and ultimately stop the controller working in a proof of concept.

A statement from Siemens sent to Dark Reading acknowledged that the levels of obfuscation do not offer enough security, and a Security Bulletin from October 2022 stated that two of the PLCs "use a built-in global private key which cannot be considered anymore as sufficiently protected."

The statement added: "Siemens has deprecated this previous version of the communication protocol and encourages everyone to migrate to V17 or later to enable the new TLS \[Transport Layer Security\]-based communication protocol."

**Improved Firmware**

That most recent Siemens firmware released in 2022 does include TLS, but Finck claims there is no "long-term service for cybersecurity issues" and calls for Siemens to provide better means to update firmware "because right now, it's wide open to anybody who could just access it over the Internet."

In its statement, Siemens said it is aware of the talk scheduled for Black Hat Europe and stated that the talk "will describe the details of the legacy PG/PC and HMI communication protocol as used between TIA Portal/HMIs and SIMATIC S7-1500 SW Controller in versions before V17."

The company stated that no previously unknown security vulnerabilities will be disclosed in this talk and that Siemens is in close coordination with the researchers. Siemens recommended users to apply mitigations, including:

*   Applying client authentication using strong and individual access level passwords.
    
*   Migrating to V17 or later to enable the new TLS-based communication protocol for all SIMATIC S7-1200/1500 PLCs including SW Controller (see Siemens Security Bulletin SSB-898115 \[2\]).
    
*   Implementing the defense-in-depth approach for plant operations and configure the environment according to Siemens operational guidelines for industrial security.
    

Though the researchers praised the response by Siemens, they noted that PLC firmware is rarely updated by users, "and there's not an established update process to quickly roll out \[updates\] to a fleet of machines."

Finck says doing updates is "probably a tedious manual process to walk to every machine, plug something in and update the firmware," and thus, Siemens needs to offer better update processes so customers have an incentive to deploy those updates.

In the meantime, he says, "you better not have a direct connection to all PLCs right now, due to the aforementioned security problems."

Version 4.5.3.4 was released to an initial group of customers on February 2, 2023. This release will be made available to all customers over the next few weeks. If you would like to get early access to new features, please contact Sophos Support.

**Release Information**

This release resolves several issues. The appliance will restart after this update.

You should also familiarize yourself with the known issues, since improper configuration of certain options may cause unexpected behavior.

Before you begin installing and configuring the Email Appliance, you should review the configuration directions.

Internet Explorer 7 and later, and Mozilla Firefox version 4.x and later, are the only supported browsers for this product release. However, the Email Appliance has been optimized for current-generation browsers. If you are using an older browser such as Internet Explorer 6 and experience performance issues, consider upgrading to a newer version of Internet Explorer, or to a recent version of Firefox.

**Issues resolved in the Sophos Email Appliance 4.5.3.4 release:**

*   Fixed potential vulnerability to CVE-2021-36806 (SEA-1779).
*   Fixed a potential vulnerability to cipher block chaining (CBC) ciphers with TLS (SEA-1656). Disabled TLS 1.1 for port 25.
*   Removed expired certificates (SEA-1846).
*   Add Amazon root certificate authority (CA) (SEA-1683).

EAST BRUNSWICK, N.J., Nov. 29, 2023 -- 1Kosmos, the company that unifies identity proofing and passwordless authentication, today announced the 1Kosmos BlockID platform now enables organizations to seamlessly extend web-based identity proofing sessions to a user's mobile device for scanning government issued documents. 

This new capability does not require a mobile application, and creates a frictionless web user journey by eliminating the need for a separate application to capture identity documents and meet identity assurance level (IAL) requirements. Unique to 1Kosmos is the use of a privacy by design architecture where personal information is accessible only upon user consent.

To enable fast and easy identity proofing from the web, without downloading a mobile application, 1Kosmos BlockID connects a browser to a session accessing the camera on a user's mobile device for document verification. It also validates the authenticity of government identity documents with issuing authorities and triangulates personal data from driver’s licenses, passports, national IDs, and more. In addition, 1Kosmos BlockID challenges the user to take a live selfie to ensure they are a real person and matches their selfie with the images scanned from the documents.
